Joe diGenova, Dobbs rip Justice Roberts for ‘pure sophistry’ after census ruling, question his conservatism

Former US Attorney for the District of Columbia Joe diGenova slammed Chief Justice Roberts and the Supreme Court for a ruling on the census.

DiGenova, who with his wife Victoria Toensing joined Lou Dobbs on Fox Business Thursday, called out the high court’s decision to temporarily block adding a citizenship question to the 2020 census while blasting Roberts for “demeaning” the court.

“What you saw today was pure sophistry,” the attorney said on “Lou Dobbs Tonight” Thursday, referring to the chief justice’s decision to side with the left in Thursday’s ruling.

In writing the majority opinion, Roberts seemed to accuse Commerce Secretary Wilbur Ross of lying about why the question on citizenship was being added to the census.

“Altogether, the evidence tells a story that does not match the explanation the Secretary gave for his decision,” Roberts wrote, slamming the government’s argument as “contrived” and “a distraction.”

Roberts’ move on Thursday came after he already angered conservatives a day earlier by siding with the liberal wing of the court, causing many to recall his 2012 decision to side with Democratic-appointed justices to uphold Obamacare’s individual mandate.

“I can’t figure out how he was ever considered a conservative,” Dobbs quipped on his show Thursday, calling Roberts an “activist.”

“He says that the motive of the Secretary of Commerce was very important,” diGenova remarked. “But in Obamacare, he said the motive of the president wasn’t important. The fact that the president said it wasn’t a tax doesn’t matter when the chief justice says, ‘you know what? I think it’s a tax.'”

“So what you have is inconsistency, but more importantly, sophistry,” diGenova added. “Fundamental intellectual dishonesty. The chief justice just wanted to stick his finger in the president’s eye. It’s demeaning to the court and it’s embarrassing.”

He called Roberts’ comment that there is no difference between Republican and Democratic-appointed judges simply “baloney.”

Conservatives torched Roberts after the census ruling on Thursday.

“I want to Impeach Roberts and Trump would get another pick. Sounds good to me,” American Conservative Union chairman Matt Schlapp tweeted.

Former White House aide Sebastian Gorka accused Roberts of betraying the U.S. Constitution.

Others piled on Roberts for his betrayal.
