Trump Organization sues Rep. Elijah Cummings to block congressional subpoena of financial records

A lawsuit has been filed by lawyers for President Trump and the Trump Organization to block the release of financial records following a Congressional subpoena.

“We will not allow congressional Presidential harassment to go unanswered,” Jay Sekulow said in a statement, who is counsel to the president.

Plaintiffs named in the complaint are Rep. Elijah Cummings, Democrat chairman of the House Committee on Oversight and Reform, and Peter Kenny, chief investigative counsel of the House committee. The suit was filed Monday in the U.S. District Court for the District of Columbia.

Earlier this month, Cummings said his committee would subpoena accounting firm Mazars USA LLC for President Trump’s financial information. Cummings cited testimony from perjuring former Trump attorney Michael Cohen, who claimed the president inflated or deflated the value of his assets when it would benefit him.

Mazars said it could not voluntarily turn over documents unless subpoenaed.

According to Fox News, “In a statement about Monday’s suit to block the subpoena, Trump lawyers William Consovoy, of Consovoy McCarthy Park PLLC, and Stefan Passantino, of Michael Best & Friedrich LLP said, “The Committee’s attempt to obtain years’ worth of confidential information from their accountants lacks any legitimate legislative purpose, is an abuse of power, and is just another example of overreach by the President’s political opponents. We look forward to vindicating our clients’ rights in this matter.”

The suit claims that Cummings and House Oversight are “assuming the powers of the Department of Justice, investigating (dubious and partisan) allegations of illegal conduct by private individuals outside of government,” solely to dig up dirt ahead of the 2020 presidential election.

The lawsuit argues: “Democrats are singularly obsessed with finding something they can use to damage the President politically.

“The Democrat Party, with its newfound control of the U.S. House of Representatives, has declared all-out political war against President Donald J. Trump,” the complaint states.”Subpoenas are their weapon of choice. Democrats are using their new control of congressional committees to investigate every aspect of President Trump’s personal finances, businesses, and even his family. Instead of working with the President to pass bipartisan legislation that would actually benefit Americans, House Democrats are singularly obsessed with finding something they can use to damage the President politically.”

On the CBS Face the Nation program on Sunday, Cummings was asked if he was in agreement with those who are calling for Trump’s impeachment, such as, Elizabeth Warren, Alexandria Ocasio-Cortez, Maxine Waters, and Julian Castro. He relied, “I’m not there yet, but I can foresee that possibly coming. Again, the fact is that I think we have to … be very careful here. The American people, a lot of them, … clearly still don’t believe that President Trump is doing things to destroy our democracy and has done a lot of things very poorly. And so I think that we need to make sure the Congress has all the information and then we need to be able to have the public know that information so that they can see that they have a president that basically has been about the business, I think, of doing great harm not only to our country but to our democracy.”
